En este texto examinaremos la relación problemática entre parrhesía, necropolítica y víctima. Nuestro trabajo estará radicado en una examinación de la necropolítica y su íntima relación con el biopoder foucaultiano, sus resistencias y efectos. Una resistencia particular está contenida en la noción de parrhesía, la cual recibirá su respectiva modificación modal ante los efectos de la necropolítica bajo las circunstancias examinadas. Con lo anterior, nuestra intención sería retratar una teoría de "víctimas y parrhesía" bajo el contexto de lo necropolítico y (...) la no–filosofía. The rise of neurotechnologies, especially in combination with artificial intelligence (AI)-based methods for brain data analytics, has given rise to concerns around the protection of mental privacy, mental integrity and cognitive liberty – often framed as “neurorights” in ethical, legal, and policy discussions. Several states are now looking at including neurorights into their constitutional legal frameworks, and international institutions and organizations, such as UNESCO and the Council of Europe, are taking an active interest in developing international policy and governance guidelines (...) on this issue. However, in many discussions of neurorights the philosophical assumptions, ethical frames of reference and legal interpretation are either not made explicit or conflict with each other. The aim of this multidisciplinary work is to provide conceptual, ethical, and legal foundations that allow for facilitating a common minimalist conceptual understanding of mental privacy, mental integrity, and cognitive liberty to facilitate scholarly, legal, and policy discussions. The increasing availability of brain data within and outside the biomedical field, combined with the application of artificial intelligence (AI) to brain data analysis, poses a challenge for ethics and governance. We identify distinctive ethical implications of brain data acquisition and processing, and outline a multi-level governance framework. This framework is aimed at maximizing the benefits of facilitated brain data collection and further processing for science and medicine whilst minimizing risks and preventing harmful use. Rare Disease research has seen tremendous advancements over the last decades, with the development of new technologies, various global collaborative efforts and improved data sharing. To maximize the impact of and to further build on these developments, there is a need for model consent clauses for rare diseases research, in order to improve data interoperability, to meet the informational needs of participants, and to ensure proper ethical and legal use of data sources and participants’ overall protection. A global Task Force (...) was set up to develop model consent clauses specific to rare diseases research, that are comprehensive, harmonized, readily accessible, and internationally applicable, facilitating the recruitment and consent of rare disease research participants around the world. Existing consent forms and notices of consent were analyzed and classified under different consent themes, which were used as background to develop the model consent clauses. The IRDiRC-GA4GH MCC Task Force met in September 2018, to discuss and design model consent clauses. Based on analyzed consent forms, they listed generic core elements and designed the following rare disease research specific core elements; Rare Disease Research Introductory Clause, Familial Participation, Audio/Visual Imaging, Collecting, storing, sharing of rare disease data, Recontact for matching, Data Linkage, Return of Results to Family Members, Incapacity/Death, and Benefits. The model consent clauses presented in this article have been drafted to highlight consent elements that bear in mind the trends in rare disease research, while providing a tool to help foster harmonization and collaborative efforts. The concept of mental privacy can be defined as the principle that subjects should have control over the access to their own neural data and to the information about the mental processes and states that can be obtained by analyzing it. Our aim is to contribute to the current debate on mental privacy by identifying the main positions, articulating key assumptions and addressing central arguments. First, we map the different positions found in current literature. We distinguish between those who dismiss (...) concerns about mental privacy and those who endorse them. In this latter group, we establish a further disagreement between conservative and liberal strategies to protect mental privacy. Then, we address the first discussion by articulating and criticizing different skeptical views on mental privacy. Finally, we try to identify what are the unique features of neural data and examine how they may be connected to the ways in which neurotechnological mindreading could put mental privacy at risk. We suggest that even if neural data is unique, it may not require new strategies to protect people from its misuse. However, identifying the special features and risks of neurotechnological mind-reading is necessary for the second discussion on mental privacy to properly take off. (shrink)

Durch genomweite Analysen werden vielfältige gesundheitsrelevante Informationen über eine Person gewonnen. Solche Informationen können die Behandlung von Krankheiten verbessern. Sie ermöglichen aber auch Vorhersagen, ob eine Person und deren Verwandte in Zukunft möglicherweise erkranken werden. Der neuartige Charakter des Informationseingriffs und sein prädiktive Potential bedürfen der ethischen, juristischen und ökonomischen Reflexion, damit diese Technologie zum Wohl der Patienten, der Familienangehörigen und der Solidargemeinschaft eingesetzt werden kann. Die vorliegende Schrift leistet mit ihren interdisziplinären, vom BMBF finanzierten Analysen dazu einen Beitrag. Grundlagen (...) für einen ethisch und juristisch verantwortbaren Einsatz der Genomsequenzierung zu medizinischen Zwecken werden erörtert und Eckpunkte für Kostenanalysen sowie Elemente einer “Guten klinischen Praxis” präsentiert. the Mona Lisa, the Mondscheinsonate, the Chanson d’automne are works of art, the salt shaker on your table, the car in your garage, or the pijamas on your bed are not. the basic question of the metaphysics of works of art is this: what makes a thing a work of art? that is: what sort of property do works of art have in virtue of which they are works of art? or more simply: what sort of property being a work (...) of art is? In this paper we argue that things are works of art in virtue of what they are like, their intrinsic features, that is, in virtue of the fact that they have the perceptual (auditory, visual, etc.) properties they have. In other words: being a work of art supervenes on perceptual-intrinsic features. Currently, this metaphysical view is extremely unpopular within the philosophy of art. It is unpopular because there allegedly exists a knock-down objection to it, the well-known argument from indiscernible counterparts. our thesis implies, among other things, that every perceptual duplicate of a work of art is also a work of art. according to the argument from indiscernible counterparts, however, there could be (or even: there are) indiscernible counterparts such that one of them is a work of art while the other is not. hence things cannot be works of art solely in virtue of what they are like. Our paper divides into three parts. In the first part we state our views. In the second part we defend it against various versions of the argument from indiscernible counterparts. This book presents the psychological basis, methodology, and application of Marton's phenomenographic approach to the theory of learning.

Various approaches have been taken recently to a reinterpretation of the European reception of China and the sinophilia-sinophobia dichotomy (Hung 2003, Millar 2010, Jacobsen 2013). In the present article, a nineteenth-century approach to China is examined using Alexis de Tocqueville (1805–1859) and John Stuart Mill (1806–1873) as examples. It will be argued that this approach differs from earlier attitudes. First, the central currents will be surveyed in the European reception of China between the Jesuit missionaries and early nineteenth-century philosophies of (...) history, introducing an interpretational framework that differentiates between various approaches to China, namely a _universalistic_ and a _progression-based approach_. Then, first Tocqueville's and then Mill's depictions of China in comparison with the concepts of preceding centuries will be analyzed. It will be argued that Tocqueville and Mill's understanding of China represents a third view that I will call _relation-based_. (shrink)

ArgumentThe subject of the paper is the shift from an astrology-oriented astronomy towards an allegedly more objective, mathematically grounded approach to astronomy. This shift is illustrated through a close reading of Tycho Brahe's scientific development and the contemporaneous changes in his communicational strategies. Basing the argument on a substantial array of original sources it is claimed that the Danish astronomer developed a new astronomical discourse in pursuit of credibility, giving priority to observational astronomy and natural philosophical questions. The abandonment of (...) astrology in public discourse is primarily explained by Tycho's social position and greater sensibility to controversial issues. Tycho's example suggests that the changes in rhetorical strategies regarding astrology (which happened earlier than changes in astrological belief) should be given more recognition in the history of astronomy. We study sincere-strategy preference-based approval voting , a system proposed by Brams and Sanver [1] and here adjusted so as to coerce admissibility of the votes , with respect to procedural control. In such control scenarios, an external agent seeks to change the outcome of an election via actions such as adding/deleting/partitioning either candidates or voters. SP-AV combines the voters' preference rankings with their approvals of candidates, where in elections with at least two candidates the voters' approval strategies are adjusted (...) – if needed – to approve of their most-preferred candidate and to disapprove of their least-preferred candidate. This rule coerces admissibility of the votes even in the presence of control actions, and hybridizes, in effect, approval with pluralitiy voting. We prove that this system is computationally resistant to 19 out of 22 types of constructive and destructive control. Thus, SP-AV has more resistances to control than is currently known for any other natural voting system with a polynomial-time winner problem. In particular, SP-AV is the second natural voting system with an easy winner-determination procedure that is known to have full resistance to constructive control, and unlike Copeland voting it in addition displays broad resistance to destructive control. Recent work in social and cultural studies of science and technology has shown that the ‘epistemic dependence’ of laypeople on experts is not a relation of blind trust, but typically and necessarily involves critical assessment of expert testimonies. Normative epistemologists have suggested a number of criteria, mostly of contextual nature since expert knowledge means restricted cognitive access to some epistemic domain, according to which non-experts can reliably evaluate expert claims; while science studies scholars have concentrated on how laypeople can come (...) to warranted decisions about technical matters on non-technicalgrounds. Instead of addressing the problem transcendentally (how such decisions are possible) or normatively (how such decisions should be reached), this paper contrasts the recommendations available in the literature with the empirical findings of a rough case study concerning the public reaction to the H1N1 vaccine issue. Awareness of how lay people do come to such decisions may inform and refine normative philosophical investigations. (shrink)

Marxist philosophers have always given great attention to theoretical questions concerning the historical role and significance of the state and to the processes by which the types and political forms of states have changed. As we know, historical materialism demands both concrete analysis of the political organization of the society of a given socioeconomic system and the discovery of certain general patterns that manifest themselves in the course of world history. Marx's thesis that reality can truly be understood only on (...) the basis of a theoretical study of history retains its full significance to this day for philosophical analysis of the complex and diverse problems of the theory of the state. The concept of the “End of History” was originally developed by G. W. F. Hegel in the Phenomenology of the spirit in 1806 (Hegel, 2018). The concept can be closely related to a utopia, the completion of the work of philosophers, and the creation of a perfect framework of the finished system of ideas. Hegel had a lot of influence on Western philosophy with the development of this idea and on Marx, who obviously thought of history in dialectic terms. However, (...) he developed the idea of “communism”, which would have been a state of humankind very similar to the concept of Hegel, with no class differences and no opiates of the people—and no place for further development (Marx & Engels, 2002). The “End of History” is based on this theoretical viewpoint that mankind has reached the final and most advanced form of societal development. However, the theorists and their intellectual followers both have to realize a painful way that the phenomenon can only be attained preliminarily. It proves to be a utopia. (shrink)

George Molnar came to see that the solution to a number of the problems of contemporary philosophy lay in the development of an alternative to Hume's metaphysics. This alternative would have real causal powers at its centre. Molnar set about developing a thorough account of powers that might persuade those who remained, perhaps unknowingly, in the grip of Humean assumptions. He succeeded in producing something both highly focused and at the same time wide-ranging. He showed both that the notion of (...) a power was central and that it could serve to dispel a number of long-standing philosophical problems.Molnar's account of powers is as realist as any that has so far appeared. He shows that dispositions are as real as any other properties. Specifically, they do not depend for their existence on their manifestations. Nevertheless, they are directed towards such manifestations. Molnar thus appropriates the notion of intentionality, from Brentano, and argues that it is the essential characteristic of powers. He offers a persuasive case for there being some basic and ungrounded powers, thus ruling out the reducibility of the dispositional to the non-dispositional. However, he does allow that there are non-power properties as well as power properties. In this respect, his final position is dualistic.This is contemporary metaphysics of the highest quality. It is a work that was almost complete when its author died. It has been edited for publication by another specialist in the subject, Stephen Mumford, who has also provided an introduction that will allow non-specialists to become acquainted with the issues. The common cause principle says that every correlation is either due to a direct causal effect linking the correlated entities or is brought about by a third factor, a so-called common cause. The principle is of central importance in the philosophy of science, especially in causal explanation, causal modeling and in the foundations of quantum physics. Written for philosophers of science, physicists and statisticians, this book contributes to the debate over the validity of the common cause principle, by proving results (...) that bring to the surface the nature of explanation by common causes. It provides a technical and mathematically rigorous examination of the notion of common cause, providing an analysis not only in terms of classical probability measure spaces, which is typical in the available literature, but in quantum probability theory as well. Originally published in 1971, this report presents Dr Jánossy’s attempt to demonstrate that all post-war economic ‘miracles’ lasted only until production levels reached the levels they should have done had there been no war and concludes that economic development is extremely consistent. Jánossy also provides a detailed growth theory which suggests that this consistency is reached purely by the development of mankind and occupational structure rather than research or capital development. Based on the existence of polysemy (e.g., lunch can refer to both food and events), it is argued that central tenets of externalist semantics and Fodorian concept atomism, an externalist theory on which words lack semantic structure, are unsound. We evaluate the premise that these arguments rely on—that polysemous words have separate, finer‐grained senses. We survey the evidence across psychology and linguistics and argue that it shows that polysemy does not exist, at least not in this “sense”.
